Terms of Service

By starting to use Mom's Diary (the "App"), you accept these terms. Please read them carefully before signing up.
1. Service Description
Mom's Diary is an information and tracking tool offering features such as baby/child development tracking, vaccine and medication reminders, community support, an AI-assisted assistant, a marketplace and a white-noise/lullaby library.
2. Eligibility and Age
- Only parents/legal caregivers aged 18 or over may use the App.
- You must sign up with real and accurate information.
- You are responsible for the security of your account. Do not share your password.
- One account is to be used by one real person (family sharing is done via the invitation system).
3. Not Medical Advice
The content in the App (including AI assistant answers, symptom assessment and articles) is not medical advice. For every health-related question, consult your pediatrician. In emergencies, call 112 (or your local emergency number).
The AI assistant and symptom assessor are for general information only and do not make a definitive diagnosis. Mom's Diary is not responsible for medical decisions made on the basis of information provided through the App.
4. Account and Responsibility
- You are responsible for all activity on your account.
- If you notice suspicious access, change your password immediately and notify us.
- Adding someone else's photo, name or personal data without permission is prohibited.
5. Content and Community Rules
The following is strictly prohibited in the community and marketplace:
- Dangerous medical advice (e.g. anti-vaccination, incorrect nutrition advice)
- Insults, threats, harassment, hate speech
- Spam, advertising, multiple accounts
- Sexual/vulgar content, violence
- Copyright infringement
- Sharing someone else's personal/health data without permission
Reported content is reviewed by an authorised person; community content is not screened by AI. Content that violates the rules may be deleted without notice and the relevant accounts may be suspended.
6. Premium Subscription
- Plans: Monthly ₺199 or Yearly ₺1,999
- Free trial: 7 days (new subscribers, once)
- Payments: made through your Apple App Store account
- Auto-renewal: the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. The renewal charge is made within 24 hours before the period ends.
- Cancellation: you can cancel at any time via iOS Settings → Apple ID → Subscriptions. Access continues until the end of the current period.
- Payment issues (grace period): if a payment fails, premium access continues for 16 days; during that time Apple may ask you to fix your payment method.
- Refunds: Apple's refund policy applies (reportaproblem.apple.com).
Premium features: 2 GB photo storage (free 100 MB), a higher AI assistant usage limit (free: 10 messages per hour; Premium: fair-use limit of 60 messages per minute; on both plans at most 100 messages per day), marketplace messaging and an ad-free experience.
7. Marketplace
- The marketplace is a listing platform between users.
- Product, payment, shipping and return transactions are between buyer and seller.
- Mom's Diary is neither seller, buyer nor intermediary; it cannot be held responsible for transactions.
- Prohibited items (medicine, medical devices, opened consumables, etc.) may not be listed.
8. Intellectual Property
- The App code, design, logo, texts and content are the property of Mom's Diary.
- You retain copyright in the content you add (photos, posts, comments, etc.). You grant us a license to use, store and copy that content to the extent necessary to provide the service.
- Third-party libraries are subject to their own licenses.
9. Account Termination
You can close your account at any time from within the App. After termination, your identifying details are anonymised immediately and the remaining data is permanently deleted after 30 days (see the Privacy Policy for details).
Accounts that commit serious violations (e.g. content harmful to children, identity fraud, marketplace fraud) may be terminated without notice. The premium subscription fee of a terminated account is not refunded; you may request a refund from Apple under Apple's refund policy.
10. Limitation of Liability
Mom's Diary provides the service "as is" and is not liable for:
- Damage arising from medical decisions made on the basis of the AI assistant or App content
- Damage arising from user-to-user transactions in the marketplace
- Outage or error of third-party services (Apple, AI service provider, error monitoring service)
- Legal disputes arising from user content
- Server outages, data loss (although we keep backups, a 100% guarantee is not given)
In no event shall Mom's Diary's total liability exceed the subscription fee you paid in the last 12 months.
11. Changes
When we update these terms, we state the new "last updated" date at the top of the page and, for material changes, send an in-app notification. Continued use of the App after material changes means you accept the new terms.
12. Governing Law
These terms are subject to the laws of the Republic of Türkiye. For consumer disputes, the consumer courts and consumer arbitration boards; for all other disputes, the Central (Çağlayan) Courts and Execution Offices of Istanbul, Türkiye are competent.
13. Operator outside the EU
The operator of Mom's Diary is established in Türkiye, outside the EU/EEA. Users in the EU may exercise the rights set out in the Privacy Policy directly with us at privacy@annedefteri.com.
